Allegation A: Replacement
The regulator called us in a case which involved a dispute between the regulator and an insurer as to whether a series of “exchanges” instituted by the company were actually replacements and whether clients were disadvantaged and whether replacement forms were required.
Allegation B: Due Diligence - Agent
A client died several months after a policy lapsed and the widow sued. At issue was whether sufficient effort was made by the agent in attempting to prevent the lapse. I was “a friend of the court.”
Allegation C: Misconduct - Agent
A company terminated an agents contract due to alleged misconduct in dealings with clients. The agent sued for wrongful dismissal. The company employed my services to help ascertain whether they should continue to fight or to settle.
Allegation D: Misrepresentation - Company/ Agent
An agent sold a number of policies on a “funding concept.” The client never saw the benefits of the concept and sued. The plaintiff’s lawyer employed my services.
Allegation E: Due Diligence - Agent
A servicing agent stopped calling a client, the policy lapsed and the client died from an ongoing illness. The beneficiary sued. The E&O carrier employed my services.
